A BUSY
TIME HERE WITHIN THE GATES OF THE FOREST
Lee County has begun to fill up.
The “snowbirds†are here in full force – as we see on the roads, in
the restaurants – even at Publix. Spring Training games begin on
March 3rd. Red Sox fans will flock to brand new Jet Blue
Stadium and the Twins faithful will be filling up Hammond Stadium.
As always, there will are charity events galore. Truly a busy time
here in the area, at least until the end of season.
MAN’S
BEST FRIEND – BUT MAYBE NOT THE
NEIGHBORHOOD’S?
Periodically, we mention the fact that there are restrictions
on pet ownership here in the Forest , particularly in terms of “dog
maintenanceâ€. When dogs are outside of their homes, they are to be
leashed. When owners or handlers walk their dogs, our rules
stipulate all “leavings†left behind are to be cleaned up and
disposed of properly.
With the
influx of visitors, renters, etc. especially now, it’s time to
remind everyone of the simple rules we have here that pertain to
dogs:

clean up and properly dispose of “doggie
– doâ€
We’ve
had a number of complaints and comments concerning this issue of
late. Please be mindful of your neighbors when taking your dog or
dogs for a walk through our beautiful Community and “do the right
thing†when it comes to their presence here.

HIGHLIGHTS FROM THE FEBRUARY FPOA BOARD OF DIRECTORS
MEETING
The
February meeting was held on the 21st – Due an earlier
publication deadline for the Forest Matters, a recap of the session
will be provided in the April edition. Last month though, we
mentioned a document that Board President David Fullen had
distributed titled “The Role of the FPOAâ€. Here is an outline
of the Homeowner’s Association’s responsibities:
The
Forest Property Owner’s Association (FPOA) was incorporated as a
“not for profit†Corporation. The Members of the Association shall
consist of all recorded title Owners of Lots, Parcels or Condominium
Units with the “Forest â€. All funds
and the title to all properties acquired by the Association and
their proceeds shall be held for the benefit and the use of the
(currently 792) Members in accordance with these Articles and the By
Laws.

are the basic guidelines in terms of the Role of the FPOA.
Implementation of policy is driven by these codes. But
interpretation of such is often up to the governing group – the
Board of Directors.
NEWS
Lighting
and Roads Chairman, Vic Erml, has announced that our periodic
repaving of Forest streets will
include Bear Cub and Bobcat Drive from Forest
Blvd to Club
Drive this summer.
In
addition Vic is working with a contractor to power wash all of our
sidewalks here in the Community. The landscaping along Forest
Blvd and Club
Drive , near both gate entrances is being
upgraded. All of these efforts will help keep the Forest clean and current for all of our
residents and visitors. .
Many of
us noticed that the new fountain at the Front Entrance was
inoperable for a good bit of time in January. Apparently a major
part, the manifold, broke. The fountain was extracted from the pond.
The part was ordered and delivered and the fountain was repaired.
And it is once again in operation.
As
mentioned in the February edition of Forest Matters, a questionnaire
has been developed and will be sent to all Forest residents/families that do not belong
to the Country Club. The purpose of this exercise is to determine
why nearly 40% of our residents have chosen not to be affiliated
with TFCC. We hope that all will take a few short minutes to
complete this survey. Participants can win a very nice prize for
their participation. Details will be provided in the correspondence
sent to each home.
As
mentioned numerous times in the past, should you have items of
interest, or news, that you’d like to share with your neighbors,
please forward it to the e-mail address shown at the end of this
piece.
FPOA
ANNUAL MEETING –
The
Annual Meeting and the regularly scheduled March FPOA Board meeting
will be held in the Country Club Dining Rooms on Sunday March
11th, 2012 @ 7 PM. The FPOA Financial Report for 2011,
election of Directors from the four Phases and other business will
be conducted. Comments and questions will be welcome. Please attempt
to attend this very important and informative Community
meeting.
Again,
the 2011 Year End Financial Report, as well as the 2012 Budget, are
available to all Forest residents.

NOTICE
TO HOMEOWNERS
Our
safety and maintenance staff are in constant surveillance of our
Community, and continually report on the condition of our single
family homes as well as our Condo complexes. With the impact of the
“recession†hopefully behind us, we as a Community look forward to
the enjoyment of our clean and fresh appearance.
While
not as many as there were, there still are some single family homes
here in the Forest that are lacking
appropriate maintenance and upkeep. Our Deeds of Restriction
stipulate that “Where any owner neglects such maintenance, Grantor
(FPOA and its Board), or his authorized agent, reserves the right to
affect such maintenance at a reasonable charge to the owner.â€
The FPOA
does not foresee the need to take action such as outlined above at
this time. However, should such conditions occur, and are not
attended to by the property’s owner, such action will be taken.
This
stipulation highlights the fact that we all need to do our best to
keep our homes well maintained – lawns, shrubs and plantings as well
as the structures themselves.

FROM THE FPOA – FEBRUARY, 2012
THE
SEASON IS IN FULL SWING, LOTS OF ACTIVITY HERE IN THE FOREST
Our
northern neighbors have returned, the weather has been terrific and
the Community is bustling once again.
We hope
that everyone agrees that our Front Entrance has taken on a whole
new positive look. The appearance as viewed from US 41 looks great.
New improved lighting, the view of the fountains, the guard house,
the lighting at night and the general appearance has really
highlighted the work that’s been done here in the Forest over the last several years.
FOREST PROPERTY OWNERS --
THOSE THAT DON’T BELONG TO THE COUNTRY CLUB
As most
of us know, there are nearly 800 residences here within our Gates.
Of those approximately 59% have an affiliation/membership of some
type with the Club. When our developer, David Swor, began building
the Forest Community in 1979, he elected to not have residents be
required to belong to the Club as a prerequisite to buying a lot or
a home here.
This can
be an advantage – or disadvantage - depending on point of view, both
to members of the Community as well as the Club as a whole. It’s
obvious though, that all residents benefit from the existence of
these two lovely golf courses, the Bear and the Bobcat.
That
being said, both the FPOA Board and the management of the Country
Club are very interested as to why around 40% of Forest residents aren’t affiliated with the
Club. Some reasons are obvious – however it would be very worthwhile
to both organizations to learn definitive reasons why.
So, in
early February, a short questionnaire will be sent to all Forest members who don’t belong to the Country
Club. Its purpose is to help quantify reasons why some of our
neighbors have chosen not to be involved with TFCC.
All
responses will be kept confidential. This is a fact finding effort
only. However, all respondents will be eligible for a nice, yet to
be determined prize that will be described in the letter sent to
these Forest residents.
Respondent’s names will be put in a hat and winners will be drawn
randomly sometime in late February.

HIGHLIGHTS FROM THE JANUARY FPOA BOARD OF DIRECTORS
MEETING
The
January meeting was held on the 17th at the TFCC
Clubhouse. There were several interesting topics covered during the
hour and a half session.
Treasurer Paul Johns reported on the 2011 year end financial
status of our Association and the picture was very bright. 2011
Operating expenses were nearly $10,824 below budget, Property
Maintenance costs were $6,749 less than budget and Administration
costs were $11,726 below. This totaled to $29,300 less than budgeted
levels for the year.
Our
revenues were $4,377 more than expected. Thus, with carryover from
fiscal 2010, ($17,712) the Association showed a net positive cash
value of $51,388 at years’ end.
In
addition, after all of the Capital expenditures of 2011, Mr. Johns
reported that the Association has a Capital Reserve Pool of nearly
$50,000 as we move into 2012.
President Dave Fullen reviewed the structure of the FPOA and
its duties as an entity. With 792 total residences here, represented
by four single home phases (three representatives each) and fourteen
Condo entities, the Association and its Board of twenty six members
are a diverse group with many special interests and requests.
Mr.
Fullen stressed that the Board is here to make decisions based on
the good of the entire Community, within the framework of its duties
and responsibilities, and has no jurisdiction over the separate
Condo Associations and their activities. (a recap of the specific
duties and jurisdictions of the FPOA and it’s Board will be reviewed
in the March issue of Forest Matters)
After
Committee reports, a lengthy discussion took place concerning the
wire fence bordering our Community on the east, along Island Park
Road . The fence is in serious disrepair.
Representatives of a Committee to evaluate this situation, Debbie
Gillespie, Board representative from Partridge Place, and Ken Stoner
of Water’s Edge, presented thoughts on how to hopefully rectify this
situation.
There
are several issues that have prevented the FPOA from acting on this
situation in the past. Key are Lee County stipulations pertaining to zoning
for work such as this that would impact the county road in question
(Island Park ). Mr. Stoner and Ms.
Gillespie have spoken with County officials concerning ways to
address these issues of
1) Security – the dilapidated fence allows intruders access
to the Community 2)
Aesthetics – the visual appearance of the fence and the plants and
trees in front of it need attention.
Action
will require approval from the County. Thus the Board authorized
this Committee to move ahead with a planning phase of this project.
Several years ago, the FPOA attempted to address this issue by
constructing a wall along this boundary. The project was rejected by
the County due to zoning ordinances. However, the Committee feels
that the County would react favorably to the plans that are being
developed and may well issue variances to circumvent some of these
previous restrictions. A report should be available by the next
Board meeting on February 21st.

Clubhouse. As usual, all Forest

2011
HOME VACATION SURVEILLANCE CHECKS
Although
we have essentially just begun our winter season, it’s never too
early to mention the home surveillance program provided by our FPOA
Safety Staff.
In 2011
over 130 Forest residents requested that our Safety Staff conduct
home checks at their homes for periods of a weekend or more –
including the summer - while homes are not occupied. Forest Safety
personnel conducted over 1,400 checks throughout 2011. In addition
to the visits to the property, homeowners are provided a log or
status report on a weekly basis concerning the status of the
property.
The
process involves our Safety Staff conducting random, weekly checks
at your property. They examine entrance ways, windows, etc. for any
unusual activity (torn screens, open doors, etc.) They also walk
around the grounds, pick up newspapers, or any other items that
might indicate that the home is not currently occupied.
If the
driver observes anything suspicious it is reported directly to the
homeowner or the person in charge of holding your key/watching your
home. If forced entry is suspected, the Lee County Sheriff’s
Department is contacted immediately.
In
addition to the Safety Driver’s checks, all gate personnel are aware
that your home is unoccupied. Your key holder information is also
logged into the FPOA computer system for ready access.
Of the
1400 plus home checks conducted, only minor incidents were
discovered – i.e. unlocked doors or windows – and corrective
measures were taken immediately. This service is provided 12 months
a year to all Forest residents,
free of charge. All
owners are encouraged to take advantage of it. To enroll, please
pick up a form from the Front Gate Office – or call 482-1109 for
more information.

THE
HOLIDAYS ARE HERE – AND THERE’S PLENTY GOING ON AROUND THE

After
experiencing over 20 inches of rain in September and October, the
weather has certainly turned into the fall-like patterns we enjoy
here in the Forest .
Activities, as well as traffic, have ramped up significantly
as our northern friends return to their summer paradise.

RECAP
OF THE OCTOBER - FPOA BOARD OF DIRECTORS MEETING
The
first meeting of the fall season was held on Tuesday the
18th Eighteen of the twenty six Board members were in
attendance. Prior to the formal start of the meeting, Dilman Thomas
of Deer Run spoke briefly of his concerns pertaining to the flooding
that had occurred in late September on and around his property as
well as the unsightly ditch that runs along his lot to the south
canal. President Dave Fullen suggested that the FPOA has budgeted
$20 K to address some of these issues.
Finance
Report – Treasurer Paul Johns presented the financial picture for
the FPOA through the first three quarters of our calendar and fiscal
year. Overall, revenues were slightly above budget due to the
recovery of several past dues charges.
Operating costs were roughly 4% higher than budgeted levels
while property maintenance costs and administration expenses were
below budget, thanks to cost efficiencies implemented by Wes
Alloway, FPOA Property Manager. The General Fund/Net Income had a
positive variance over budget of over $33,000 and after payment of
all invoices for mail boxes, front yard light poles and new front
entrance improvements, the Capital Reserve balance is over $55,000.

Committee Reports
Grounds – Gary Hamilton -
All operations are on or under budget. New mulch to be delivered
shortly and will be placed appropriately.
Safety – Wes Alloway – As
mentioned in previous articles speeds of vehicles using our streets
have been recorded periodically throughout the summer. A summary of
speed check results was reviewed for six - seven day periods in
July, August and September. The study showed that of 22,512
readings, 94% of the vehicles were recorded at or below 25 MPH,
another 5% between 25 MPH and 30 MPH. Thus, over the summer at
least, it appears drivers traveling at a high rate of speed through
the Forest is not a significant
issue. We will see if this condition holds true during season with
increased traffic from residents, visitors, contractors and delivery
vehicles.
Lighting – Wes Alloway
- There were ten front
yard lamp posts that are not illuminated contrary to FPOA statutes.
Six are in foreclosure, the others do not respond to requests to
supply power to the lights as required. If this condition is not
resolved, individual cases will be referred to the FPOA Grievance
Committee for action
President’s Report/New Business
President Fullen addressed several issues:
There
had been questions concerning the removal of selected stop signs at
major intersections throughout the Forest . A traffic analysis report from the
Johnson Engineering group was presented and stated that that those
signs should not be used as a speed deterrent on major streets
within a community and that their removal was appropriate. Signs
stating that Cross Traffic Does Not Stop should be placed under all
remaining stop signs on side streets entering the more heavily
traveled roads.
The
flooding issues mentioned previously will be addressed, as well as
problems with both the North and South Main Canals running along the Forest boundaries. The canals were last
dredged by Lee County in 2006 and are in need
of such clearing again. Two weirs (drainage outfall structures) are
problematical. Both Source Engineering – the company responsible for
the design of these weirs – and Southwest Florida Water Management
will be consulted on this issue.
The new
Front Entrance area was discussed. The bushes and grass planted in
back of the pond had grown quicker than anticipated, making the area
perhaps looking “greener†than anticipated. They have been cut back
and annual plants will be added to provide more color. Members of
the Dove’s Nest Condo Association, who contributed financial support
to the project, were very happy with the outcome according to Bill
Petersen, Condo Association Board representative.
The
break-ins that occurred in Partridge Court in September
were discussed. As mentioned in Forest Matters last month, Wes
Alloway reported that the surveillance cameras detected no unusual
activity in and around the back gate area at the time of the
incidents. This conversation led to a discussion of how to possibly
upgrade and secure the back fence along Island Park
Road . Debbie Gillespie of Partridge
Place will head a Committee to
investigate ways to accomplish this.
A
possible project to provide the Forest with monthly street sweeping service,
as mentioned earlier, was discussed. Several Board members had
reservations concerning this initiative. A representative of Lee
County Natural Resources will be invited to the November Board
meeting to outline the pros and cons of the program and answer
questions.
President Fullen asked for a motion and vote to amend the
FPOA Rule concerning Gate House Access and fees/restrictions
concerning Bar Code stickers used for entrance into the Community.
It was moved by Ms. Gillespie, seconded by Ms. Griffin and passed
unanimously.
The
Committee to review and recommend the 2012 FPOA Budget was named –
it will include Paul Johns, Bud Hornell, Gary Hamilton, Debbie
Gillespie, Victor Erml and David Fullen.
The hour
and twenty minute meeting was adjourned at 8:20
RECAP
OF THE NOVEMBER – FPOA BOARD OF DIRECTORS MEETING
The
November 15th FPOA Board Meeting was attended by twenty
four of the twenty six Board members as well as a number of
Forest community
members.
Prior to
the formal start of the meeting, Karen Bickford of the Lee County
Natural Resources Department made a brief presentation concerning
the previously proposed Street Sweeping Project that her Department
had requested implementation of here in the Forest .
An EPA
mandate had requested her group to monitor and control water quality
flowing into the Hendry
Creek Basin , a large area behind the Forest that includes a large mass of preserve
and waterways. The project here would be an attempt to quantify
whether or not run off from streets here in the Forest has an impact on this water quality.
This one year pilot program would include having our streets swept 4
to 6 times during the twelve month period. There was no obligation
from the Forest to continue the
program after the one year pilot period. There would be charge for
the service to our Community.
Ms.
Bickford left the meeting after her presentation. During the regular
meeting a short time later, the Board discussed the value of
participating in this pilot program. After much discussion it was
voted by a count of 18 to 6 not to participate.
The
formal meeting began with the Treasurer’s report submitted by
President Fullen. Through ten months the Forest financial situation is very solid. Key
components: General Revenues are $6,246 above budget while Operating
Expense are $13,561 better than budgeted levels, Property Management
charges are below budget by $12,623 and Administration costs below
budget by $9,202 giving us a net Operational surplus of plus
$35,342.
In
addition the Capital Fund shows an Ending Balance of plus $24,218
while the 2011 Pooled Reserve is plus $27,938 giving us a $52,156
positive Capital/Reserve Balance.

Lighting
The new
Oaks Trees planted behind the Fountains in the new Front Entrance
configuration will be illuminated this week. Christmas Lights will
be activated just after Thanksgiving.
New
Business – the 2012 budget
The new
Budget had been released to FPOA Board Members last week for review.
Several members of the Forest Community, primarily condo/villa
owners, were in attendance and four spoke prior to the start of this
meeting, expressing their concerns about its content.
The
major change in the budget was a shift down of the fiscal burden
carried by the single home owners. Over the last several years the
difference in what single family owners and condo owner’s pay into
the Capital Fund portion of the Budget has grown to $194 per year.
(i.e. in 2011 single family owners paid $372 per household into the
Capital Fund while condo owners paid $178 yearly). Since capital
improvements to our Community are done for the betterment of all 792
homeowners (both single family and condo owners), the Finance
Committee restructured the yearly fee for 2012.

There are 791 residences here in the Forest – 62% are Condo/Villas, 38% are single
family homes.
During the discussion prior to the beginning of the meeting,
a resident questioned the legality of the restructuring of the
components of this Budget. He based this claim on perceived changes
in Florida Statutes pertaining to Homeowner’s Associations passed
earlier this year.
Thus, using the above formula for equating the services and
amenities provided by the FPOA of all of its residents more equally,
this Budget configuration was passed by your Board with a vote of 18
in favor, 5 opposed with one abstention – contingent on verification
of the legal claim mentioned.
The
meeting was adjourned at 8:30
The next
FPOA Board meeting will be held on January 17th, 2012, as
usual in the Forest Country Club Conference Room. All Forest residents are welcome to attend these
meetings. Attendees are given an opportunity to ask questions and/or
make suggestions prior to the start of each session. We hope that
you’ll make an effort to learn more about what’s going on here in
your Community.

INTEREST AS WE MOVE TOWARDS SEASON AND THE RETURN OF OUR NORTHERN
FRIENDS AND NEIGHBORS
Fall is
here – and with it better and more comfortable weather. While we are
not “out of the woods†yet in terms of tropical weather patterns,
our highest hurricane exposure period has past. This is not to say
that we have not had our share of significant rain events over the
last month, including over 4 inches in about an hours’ time, with
hurricane-like winds, on September 19th as well as over 2
inches in a short period of time on October 17th. These
rainy patterns have provided lush, green lawns and common areas, as
well as full ponds and lakes throughout the Community.
FLOODING
HERE IN THE FOREST
During
the above mentioned rain event of September 19th, along
with additional rains that week, significant flooding occurred along
Deer Run and back onto the Country Club grounds. It affected holes
#2 and #3 of the Bear Course in particular. Due to this flooding the
Course was unplayable for nearly two weeks. Of even more importance
was the threat of flooding to homes, particularly those with lower
elevations, along Deer Run and perhaps other areas within the
Community.
The
cause of this flooding was an impediment to water flow in an outflow
structure that flows into the south canal behind homes on Deer Run.
It was installed in 2009 by the FPOA as per the direction of
Southwest Florida Water Management. We have not had a rain event of
the magnitude of the event on September 19th since this
installation, thus the impact was unknown until this flooding
occurred. This condition will be addressed by your FPOA Board and
hopefully rectified with SWFWM in the very near future so as to
prevent another such occurrence.
FRONT
ENTRANCE PROJECT
Again,
the work has been completed. The fountain is operating at full
strength including attractive lighting that shows nicely at night.
Several people have noted that there appears to be too much “greenâ€
in the display behind the pond and along the banks. Matt Cann, our
TFCC Course Superintendent and Project Manager, reiterates that, as
time progresses, and with the addition of seasonal plantings, there
will be more attractive coloring around the pond. As we all know,
things grow and mature very quickly here in Southwest Florida and we should see some
additional brightness and liveliness in the near future.
SPEEDING
WITHIN THE COMMUNITY
As
reported over the summer months, the FPOA Board had placed a Radar
Speed Detector device in various places throughout the neighborhood
to monitor vehicle speeds. Wes Alloway, our Property Manager, has
provided periodic reports on the range of speeds over the course of
the summer. For example a recent check along Deer Run at Pheasant
Court showed the following pattern for a
seven day period: 4,450
recorded speeds
0-25 MPH
- 96.8%
26-30 MPH – 2.9%
31-35 MPH – 0.2%
36-40 MPH – 0.1%
So the
vast majority of drivers along the southern edge of the Forest seem to be complying in terms of our
speed limit. However some still don’t stay within our posted 25 MPH.
The Radar Device will continue to be placed through the Community to
remind our residents and their guests/contractors that speeding is
still an issue here and will be taken seriously so as to avoid
problems as we move into our winter months.
SAFETY
CONCERNS HERE IN THE FOREST
On
September 28th, three Condos in the Partridge
Court section of our Community were
entered illegally. The Lee County Sheriff’s Department is
investigating these break-ins and are looking at a local person or
persons “of interestâ€. There were dogs present at two of the
residences but the intruder(s) were apparently not deterred. Small
items and loose change were taken, the value around $3,000 in total.
There
are seven cameras situated in and around the Back Gate/Island Park
entrance. After close examination, there was no evidence of any
unusual activity in the area around the date of the condo
intrusions, leading to the conclusion that the robbers worked either
from within the Community or were able to scale the perimeter fence
to gain entry.
Periodically, we encounter situations such as this one. Wes
Alloway relates that:
- We are a GATED COMMUNITY –
that is a residential complex featuring walls and fences with a
controlled entrance. We are staffed by a uniformed Safety/Security
staff and utilize a very advanced closed circuit television system
to monitor entrances and surrounding activity.
- Forest GATE ATTENDENTS AND NIGHT DRIVERS
follow the motto “detect, deter, observe and reportâ€. Their primary
functions are to provide our residents with privacy, report any
trespass/unauthorized entry situation to the Lee County Sheriff’s
Department, sound an alarm in case of emergency, observe and report
any crime or evidence of crime, illegal activity or any FPOA Rules
violation. These personnel are unarmed and, for their safety, are
not required to confront possible dangerous situations that may
present themselves, rather they are to report instances immediately
with a “911†call to the authorities. (Florida State Statute 493.6118(1)(l) –
Security Officers are NOT Law Enforcement Officers and are not
granted police powers)
- Our
Safety/Security staff does not provide law enforcement. The FPOA has
spent thousands of dollars to enclose our perimeters with concrete
walls and fences. However, these safety measures will not
necessarily stop someone who truly wishes to enter our Community.
Also, criminal acts here in the Forest can be internal in nature – perpetuated
by a dishonest contractor, perhaps an employee or even one of our
neighbors. Prior to a break in, or other act of aggression, the
residence in question may be watched for days or weeks before the
actual act takes place. It’s up to us as individual homeowners to
participate in the safety of our Community. Each of us is the best
deterrent to crime. Locked doors, closed garages, locked vehicles
and possessions stored outside, alarms and the common sense measures
that we all know of are our best line of defense in terms of
security.
- FPOA
Budget Allocation – Safety/Security. Many residents believe that the
bulk of our homeowner’s fees are used for safety and security.
Actually, our budget representation in broad terms is: Grounds 46%,
Safety/Security 44% and Administration 10%. This indicates the
diversity of our FPOA budget process.
SUMMER
NEIGHBORHOOD IMPROVEMENTS
FPOA
Vice President Vic Erml – provided the following update of
activities since
spring:
- Painted directions are now
in place for vehicles exiting the Forest onto US – 41 from the Front Gate as
well as indicators for the safest passage crossing from the gate to
Timberlakes
Drive , after entering the property.
- Ninety degree and road
reflectors were installed at three locations within the Community –
Deer Run and Bobcat
Drive , Timberlakes Drive and Cougar
Run and Forest Oaks and Spotted Fawn
- Twenty nine
street lights owned by the FPOA were
painted to match the colors of our new mail boxes and yard lamps. In
addition high pressure sodium lamps were placed in each of these
lights to match the lamps used by FPL in the street lights that they
own within our Community.
- Larger, more powerful
lamps, along with fixtures, have been installed at the front
entrance of the Community providing much better light and exposure
from US – 41 at night.
- Panther Paw was repaved as
part of our ongoing street maintenance program
-
Pavers have been installed at all golf
cart and walking crossings over Forest streets throughout the neighborhood.
These are the same type of pavers used at the front gate.
FPOA BOARD MEETINGs – OCTOBER and
november
The
first fall meeting of the FPOA Board of Directors was held on
Tuesday October 18th.
Unfortunately the production date for our November issue of
Forest Matters was too close to the meeting date, preventing the
inclusion of a recap of the meeting in this edition. There will be a
summary of events for both the October and November Board meetings
in the December Forest Matters.
The
November meeting will take place on Tuesday the 15th @ 7
PM at the Forest Country Club. The Board of Directors will begin
approval of the 2012 Budget at that time. The Board encourages each
and every resident to attend these meetings. As always, visitors are
welcome to ask questions, make suggestions or comments prior to the
start of each Board meeting.

FROM THE FPOA –
ITEMS OF
INTEREST AS WE MOVE THROUGH THE “DOG DAYS OF SUMMER†AT THE
FOREST
After a
pretty dry period in June and into early July, when it seemed it was
raining everywhere in Lee County but here, we finally began to
experience the summer rainy season that we’ve expected. With the
rain has come the comeback of most of the lawns in the neighborhood
as well as the “overnight†growth of our bushes and plantings. Now
if we can avoid the larger than normal number of tropical storms
being predicted, we’ll enjoy the remainder of our summer and look
forward to the fall.
FRONT
ENTRANCE PROJECT – As of this writing, project work has essentially
been completed. The lake bank behind Dove’s Hollow (hole number 14
on the Bear Course) has been restored. All plantings have been
placed and the re-sodding needed was completed on August
3rd. The oak trees behind the peninsula are in place as
well.
The
fountain should be in place by the end of August as well as the
illumination. While as yet there is little color in the plantings,
Matt Cann, TFCC Golf Courses Superintendent and Project Manager,
suggests that the color in the permanent plantings will appear once
they become a bit more mature. The winter annuals to be planted
later this year will lend a good deal more color to the area making
it the kind of attractive entrance display we’re expecting. The
entire project should be completed by early September.
THE
ISSUE OF SPEEDERS IN OUR COMMUMITY – As mentioned previously, a sub
committee of Forest Residents/FPOA Bard Members has been working
with Wes Alloway to develop ways to deter speeders on our Forest streets. As we know, many measures have
been tried over the years to accomplish this goal. The Committee
recommended that we install a Radar Speed Detector along a selected
street within the Community. Many of you who travel along
Timberlakes
Drive noticed the device that records and
illustrates the speed of an oncoming vehicle. The device was
situated along Timberlakes near Bear Cub Court , heading in the
direction of the Front Gate.
Over a
week period – July 25th through July 31st -
the Radar device recorded 2,638 readings. The break of speeds
recorded was somewhat surprising:

At least
along this stretch, it doesn’t appear that speeding was a huge issue
during the latter part of July. However, as one FPOA Board Member
commented, it will be worthwhile to monitor the speeding situation
once our friends from the north return in the fall. The Radar
Detector will be moved around the Community during the summer to
obtain more information on Community speeding tendencies
As we
know, the speed limit here on Forest streets is 25 MPH. Overall, the
residential speed limit throughout Lee
County is 30
MPH. But if just one incident occurs here in the Forest because of speeding it will be one too
many. We need to continue recognize that speeding and reckless
driving can only mean problems here in the Community.
DID YOU
KNOW?
Some of
us may not be aware that the development of the Forest Community
began back in 1979, over 30 years ago. The TFCC Bear golf course
opened in 1980, the Clubhouse in 1981 with the Bobcat becoming a
reality in 1987. The history of the Forest Community, founded by
David Swor, and originally John Santini, is a fascinating one. Over
that time the Club and the Community have become necessarily
intertwined.
As we’ve
seen, the FPOA Board continues to make needed improvements to our
Community to keep it current and fresh during these competitive
times. With our neighborhood now completely built out, we will
continue to see instances of tear downs and rebuilds of some of our
older existing residences. These new homes will help to maintain and
hopefully increase the values of our existing properties.
And, the
Country Club Directors have, over the last several years, seen to it
that the Club maintains its position as one of the premier
facilities here in Southwest
Florida . New residents move here for numerous reasons –
location, neighborhood, maturity, the gated community feature and
many more. But they also are attracted by the beautiful surroundings
provided by the scenic golf courses within our midst. The Forest
Community and the Forest Country Club are one – regardless if all
members of the Community are members of the Club or not, as David
Swor envisioned over thirty years ago.
THE
FOREST A “TEST†COMMUNITY FOR LEE
COUNTY? (continued)
In the
last edition of Forest Matters, we discussed the possibility of the
Forest Community working in conjunction with Lee
County on a
pilot test Street Cleaning initiative.
As
reported, the County is subject to a Federal Clean Water Act (CWA)
mandate to improve water quality in the Hendry
Creek Basin within the next five
years and beyond. The Forest is
included within this definition.
The
County had offered to provide free monthly vacuum street sweeping
service (VSS) here in the Community as a test to determine if in
fact VSS will help improve water quality within the Hendry
Creek Basin . Apparently the County
has a budget available to execute this service for one year free of
charge. Cost for subsequent service would be evaluated based on
County budget availability and the outcome of the
program.
Wes
Alloway has spearheaded this initiative from the FPOA standpoint.
While this seems like a program that might well benefit the
Forest , several Board members have
expressed their apprehensions about our commitment and are seeking
more information.
Karen
Bickford of the Lee County Natural Resources Department plans to
attend our first meeting this fall – October 18th - to
provide more details and answer questions. As always, all Forest residents are welcome to attend to
learn more about this project.

FROM THE FPOA –
HURRICANE SEASON NOTES, A FRONT ENTRANCE UPDATE PLUS OTHER
NEWS AND PROJECTS OCCURRING THIS SUMMER
Well,
summer is in full swing here – typical hot weather in Southwest Florida . Activity has slowed
significantly as our northern friends have returned and year
‘rounders are taking their summer trips.
The FPOA
Board did not meet in May or June; the next scheduled meeting will
be in October when most Board members will be back here in the
Forest .
Several
initiatives are taking place this summer as a result of actions
taken by your Board earlier in the year:
The new
pavers at ten golf cart crossings on our roads throughout the
neighborhood are being installed and should be completed by July
1st. These are the same paver bricks used at our gate
entrance and they add a real touch of distinction to the
neighborhood as well as create somewhat of a deterrent to excess
speeding. A nice addition to the aesthetics of the Community
recommended and implemented by Board Member Ron Cramer.
As part
of the ongoing road renovation program here in the Forest , Panther Paw is being resurfaced in
July. Cougar Paving, a subsidiary of C.R. Roberts, will do the work.
As mentioned previously Road Maintenance Chair Vic Erml has planned
for more of our roads to be resurfaced over the next several years
in an attempt to keep our streets as current as possible. Bobcat
Drive from Forest
Boulevard to the entrance to the Country
Club will be next.
As
mentioned previously several homes/properties within the Community
continue to be in disrepair. Some are still inhabited by their
owners; others are bank – owned as a result of foreclosure. The FPOA
Board has authorized Property Manager Wes Alloway, with direction
from our attorneys, Becker & Poliakoff, to actively seek remedy
of the unsightly conditions of these properties. This process will
continue throughout the summer until resolution. More to follow.
HURRICANE SEASON
UPDATE
The Lee
County Sheriff’s Department has submitted the following article to
Wes Alloway concerning the upcoming Hurricane season:
“Hurricane season is now underway from June 1st
through November 30th. If you have not dome so check your hurricane
plan, or get one started. Check your hurricane supplies (food,
water, medical supplies, etc.) chain saw, generator or any other
equipment you have purchased in preparedness for a hurricane or
disaster. You are reminded that The Forest is located in a Storm
surge Risk Category 1, and is less than 15 feet above sea level, and
there is a good possibility that you will need to evacuate. When the
next hurricane threatens, you must decide whether you will: stay
home, stay with friends or relatives in a safe place, relocate out
of the area or go to a public shelter. The most important thing you
can do for yourself, your family and your property is to make a
HURRICANE PLAN, long before storm threatens. If you decide to leave
the area, it is best to leave well before the storm. Once
evacuations are ordered, roads will become clogged. The following
Watch or Warning will be issued by local authorities:
1)
TROPICAL STORM WATCH – Tropical
storm conditions with sustained winds from 39 to 74 mph are possible
in The Forest within the next 36 hours
2)
TROPICAL STORM WARNING –
Tropical Storm conditions are expected in
The Forest within the next

HURRICANE SEASON FROM
A LAW ENFORCEMENT PERSPECTIVE
As we
enter the 2011 Hurricane Season, the Lee County Sheriff’s Office
encourages residents to prepare for the possibility of a devastating
storm and to know in advance what you can do to keep from becoming a
victim of fraud once the storm has passed. Below are suggestions you
may consider taking action on beginning today:
1) Shop
perspective contractors in case you need someone to repair your
roof, pool cage or home. Early research with the Department of
Business Regulations and the Better Business Bureau on a company’s
track record can save you from making a big financial mistake during
an emergency. Once you’ve narrowed down your list of potential
companies, call and ask what their hurricane plan is and how you
should contact them if you need their services.
2)
Gather all of your medical records and property insurance papers,
immunization records, and other important documents and place them
in a rugged, weatherproof container. You may consider sending a copy
of these documents to a family member who lives outside of the area
for safekeeping.
3) Plan
ahead and be extra prepared if you have a relative or friend who has
special needs. Check early for hurricane shelters that best meet
their needs.
4)
Establish an out-of-town phone number with family and friends to
relay messages about your whereabouts and safety after the
storm
5) Put
shutters and other window and door protection in place when
instructed by local weather and law enforcement officials. Do NOT
put them up too soon due to safety and fire hazards. Putting them up
too soon can cause escape and rescue problems as well as liability
issues with your insurance company. If you are not sure about your
homeowner’s policy regarding hurricane shutters contact your local
insurance agent.
6) Begin
creating your hurricane emergency kit now!! Remember to have at
least 3 to 5 days worth of food and water per person: along with
other important items such as flashlight, a can opener, a battery
operated radio or television and a corded phone.â€
FOREST FRONT ENTRANCE
PROJECT
As of
this report, the work on the front entrance is moving along with
heavy equipment having removed the waterfall and digging out areas
around the pond in the front.
The
following is a summary submitted by Project Director Daryl Voitek
and FPOA President Dave Fullen concerning the effort.
“News on
the Entrance to our Community
Preface
In the
beginning, there was an Entrance Committee formed of representatives
from the Forest Country Club (TFCC), Forest Property Owners
Association (FPOA) and Dove Hollow. Over the next several months
discussions evolved around the following key points: keep the
waterfall, replace the focus with a fountain, scope of landscaping
and issues with the entrance pond (erosions and algae).
The
process was slow, but with a commitment to developing a
comprehensive plan. Time was required for both sides of this coin:
comprehensive and detailed. Part of the discussion included
consideration of professional services in the form of a Landscape
Architect (a unanimous yes vote). From that point forward a plan was
developed was developed and continually refined at a detailed level.
A goodly part of this refinement was due to discussions and
presentations which each of the major groups represented (TFCC, FPOA
and DH) as well as individuals and groups with alternative
approaches. The result was a refinement of the basic plans over time
and meetings. The agony of democracy was experienced with a fruitful
outcome.
The
Plan
There
will be several groups of plants with significant flowering (Golden
Thryallis, Fire Bush, Walters Viburnum, Porter Weed, Muhly Grass,
and Pickeral Weed). Add to that the color from the annual flower
beds and there will be color in the entrance area for most of the
year. Landscaping will continue along the pond for about 750 feet of
pond edge with Littorals (water loving plants) to retard our current
erosion problem. The major structure of the landscape will be Live
Oaks ‘Cathedral’ and Pond Cypress (fuller crown than Bald
Cypress)
The
landscape plan is rich in form and textures and at the same time
represents the subtle beauty of Florida ’s native landscape. The
irrigation needs, once established will be minimal for most of this
landscape. Watering needs for the Floritam (St. Augustine )
sod and annual flower beds will require additional irrigation on
specific zones.
Once the
decision was made that the fountain would be the active focal point,
there was significant time spent in reviewing operational fountains.
The form selected is a geyser form with three different levels of
geyser. Geysers are “foamy†in appearance which gives them substance
as a focal point as well as providing increased aeration. The
fountain will come with lights. Maintenance will be provided at a
rate of $150 per quarter. There will also be another aerifier added
to the west part of the pond to assist in improving water
quality.
Budget and
Summary
The
budget for this project is $70,000, a significant sum even for a
comprehensive project of this size. The project is quite important
to all of the entities represented for the same reason: we need to
maintain our Community and demonstrate our commitment to all who
enter our Community. We have improved our entrance significantly,
now we will have the landscape and focal point to complement the
entrance facility. Our Community is no different than a 30 year old
home; both need continued maintenance and updates from time to
time.
Finally,
this project brought three different Community entities together to
address a common issue. The cooperation between each has been
excellent. There will be many more Community related issues that
could be addressed and solved with such collaboration that would add
to the betterment of the entire Communityâ€
Again
work continues on the completion of this sorely needed improvement
to our front entrance way. An up date will be provided in the August
issue of Forest Matters.
As we
move into the real SW Florida
summer, please stay cool, hydrated and hopefully we’ll stay storm

FROM THE FPOA
The first of
May and things have started to quiet down somewhat around theForest .
However,
March and early April, were a busy time here in the
Community.
There
were two FPOA Board Meetings held in March:
On
Sunday the 13th, the ANNUAL MEETING for the entire Forest
Community was held. A quorum of 262 members, either in person or by
proxy, was present. After President Dave Fullen reviewed the duties
and responsibilities of the FPOA/ Homeowner�s Association, he
reviewed Association capital and operational expenditures on
Community improvements conducted over the last five years. Treasurer
Paul Johns then presented the 2010 financial results including the
outlook for fiscal 2011. There was a positive carryover from the
Capital Fund and Pooled Reserve of $43,647 going into
2011
Gary
Hamilton recapped improvements and plans for landscaping throughout
the community including work that was done in Ruthie�s Park and
various cul-de-sacs and medians
Victor
Erml reviewed the expenditures made on our roads and lighting
throughout 2010 along with plans for 2011 which will include
repaving of Panther Paw as well as the installation of yard lights
in Phases II, III, and IV and participating Condo Communities. 145 street signs within the
neighborhood are being upgraded in 2011, and street lights owned by
the FPOA are being painted and upgraded as well. He also reviewed
some of the preliminary plans being developed by the newly activated
Long Range Planning Committee that will continue to enhance the
Forest .
Mr. Erml
was elected as a Director for Phase III, Cheryl Rea as a Director
for Phase IV and Anita Ryan was appointed to fulfill the term of
Suzanne Sutton in Phase II.
A vote
to waive the audit of FPOA financials, an option afforded the
Homeowner�s Association by the State of
Florida
, was
passed by a vote of 175 yes and 12 no.
At the
conclusion of the Annual Meeting, a brief regular Board meeting was
held. Officers of the Board were elected unanimously for the
2011-2012 term: Mr. Fullen as President, Mr. Erml as Vice President,
Mr. Johns as Treasurer and Bud Hornell as Secretary.
On
Tuesday, March 22nd, a SPECIAL FPOA BOARD MEETING was
held. It was essentially to review the parameters of the plans for
the reclamation and renovation of the
Front Entrance Way
to the Community. After comments from
community guests, some advocating an alternative plan to the one
presented below, the meeting commenced.
The
proposed plan for these renovations was presented by Darrell Voitik
representing the Renovation Committee which was comprised of FPOA
Board Members, TFCC members and staff as well as input from the
Doves Hollow Condo Association. A motion to approve the plans
submitted by the Committee was made by Bobbee Gabelmann and
discussed further. It was noted that the FPOA would assume
responsibility of the electrical costs associated with running the
proposed fountain to be placed in the pond in front of the
deteriorating water fall that currently exists. TFCC would assume
all maintenance responsibility for the property. The motion was
passed by a vote of 12 yes and 6 no, with 2 Board Members
abstaining.
Work on
these renovations will begin as soon as permits are secured from
Lee
County
. A
rendition of the plans being implemented will appear in the June
edition of Forest Matters.
Carl
Kreager presented the agreement developed between FPOA and TFCC
concerning responsibilities for the water management function here
within the
Forest . The agreement
had been approved by TFCC Board earlier. The motion to accept this
proposal was approved unanimously by the FPOA Board.
The
By-Laws applicable to the Forest Community and the FPOA have been
updated by our legal group, Becker and Poliakoff and dated
2/28/2011. After discussion the new revised By-Laws were approved
unanimously.
OTHER
NEWS
Board
Member Jane
Griffin
has asked us one and all to
abide by the posted speed limits within our Community. It�s apparent
that speeding continues to be a real problem here on
Forest streets. Speed bumps and humps have
been installed in selected areas to help curtail excessive speeding
by cars and trucks. However, this approach has pluses and minuses,
as we know. Mrs. Griffin has issued the following note for us to
consider:
�WE NEED YOUR
COOPERATION
- It is
essential for all who use the Forest roadways that we drive at, or close to,
the posted speed limit.
- The
section of Timberlakes
Drive between Forest Oaks and Spotted Fawn Court has been identified as a section where
many drivers are dramatically exceeding this limit, with the
possibility of causing great harm or death.
- The
FPOA Board of Directors has been asked to investigate and implement
a solution to this problem. The
installation of severe speed bumps could curtail this problem but
is not the idea solution,
- I
believe that all of the drivers on our roads want to drive
responsibly and none would want to be the cause of harm to
others.
- As a

Again,
speeding continues to be a problem within our Community and at some
point it will lead to a situation that none of us want to see.
President Fullen has requested both Vic Erml and our Property
Manager Wes Alloway to investigate ways to better enforce our speed
limits here in the Community. More to follow on this in future
messages here in the Forest Matters.
For the
most part, the Forest Community has not experienced significant
damage to our image and
appearance during the recession that we�ve faced since 2008.
Overall, single family homes and Condo areas have been well
maintained, with a few exceptions, over this period of time.
However, there are several visible instances of lawn and property
neglect and deterioration appearing recently that can certainly
impact our Community.
Wes
Alloway has submitted the following:
�Springtime and time for some much needed yard maintenance
for several lawns here in the
Forest . All lawns and landscaping in the
Forest are required by the Forest
Deeds of Restriction to be maintained in keeping with the general
character of our subdivision.
If your
lawn and landscaping has become unsightly you will receive a letter
from the FPOA requesting that you take action to correct these
conditions. Your Deed Restrictions state: �Where any owner neglects
such maintenance, Grantor, or his authorized agent, reserves the
right to affect such maintenance at reasonable charge to the owner.�
Should corrective action NOT be taken in a timely manner, you may
receive a second letter as follows:
�Your property has the
appearance of being abandoned. If repairs are not completed as
requested by (date inserted) and some type of weekly maintenance
program to maintain the property regularly is not instituted, The
Forest Property Owners Association (FPOA) will affect such
maintenance at your cost.
In addition, the
FPOA will recommend to its Grievance (Fining) Committee a possible
fine. As per our By-Laws, the Committee may levy a FINE not to
exceed $100.00 per violation, on the basis of each day of the
continuing violation, and may not exceed $1,000.00 in total. If a
fine is levied by the Committee, as required by Florida Statutes
Chapter 720, you will be given a 14 day notice to invoke a hearing
to appeal.
The
Forest Property Owners Association does not wish to take such
action, but will do so if necessary. Please take corrective action
to restore your property to an acceptable condition in keeping with
the general character of our subdivision�
It�s
important that we all do our best to maintain the character and
beauty of our Community.
Finally,
resident Dr. Gerri Reeves submitted a reminder that fireworks other
than sparklers should not be detonated here in the Forest . Celebration of special Holidays and
events are fine, these fireworks however can be detrimental,
particularly during dry periods here in Southwest Florida .

Well,
the Holidays are behind us and we will soon have most of our friends
from the north back here again in the Forest Community.
The last
meeting of the FPOA Board was held on Tuesday, November
16th. (due to the Holidays, and Board Members? travel,
there was not a December meeting)
BOARD
MEETING SUMMARY
The key
segment of the November meeting was the presentation of the 2011
Budget to the FPOA Board. Treasurer Paul Johns reviewed the
components of the Budget, including Operating Income versus
Operating Expenses of $582,282 as the base of operations. This is
approximately 2% lower than 2010 actual levels.
Annual
fees per household for 2011 will be: Single homes (budgeted at 298
units) ?
$ 1,231
per unit ? Condos (budgeted at 487 units) - $ 838 per unit. Both single home and condo
units pay equally into the Operating Budget - $ 660 per household.
The differences are allocated to the Capital Reserves contribution
used for the installation of Yard Lights in the remaining Three
Phases as well as other projects.
Included
in the Capital Expense portion is Yard Light replacement at 225
homes in Phase II, III and IV, and additional Capital Projects
(including power washing of the sidewalks within the Community).
From the Pool Reserve, moneys are allocated for road
repair/repaving, operational equipment (gate operators, wells, laser
heads at the guard gate, etc.) and water management issues (culvert
repair/replacement in conjunction with the Country
Club).
The 2011
FPOA Budget is available to any
Forest resident wishing to obtain a copy.

the 2010 Year End financial Report will by available by January
15th, 2011.
In
addition to the Budget Review, Mr. Johns summarized 2010 income and
expense trends for the first ten months of our calendar year. After
ten months, income versus expense showed a positive variance of
$36,191. This ratio may be reduced by years? end due to late year
expenses being offset by limited income receipts.
RULES: Latham
Gray had reviewed the pending revised Deeds of Restriction for Phase
II, III, and IV with their corresponding FPOA Board Representatives.
With a few minor changes the Board Representatives approved these
new documents.
The
proposed/revised Deeds of Restrictions have been mailed to ALL
homeowners in the three Phases ? II, III and IV. They should be
reviewed carefully. Please return the PROXY in the postage paid
envelope provided. Since ratification of each subdivision?s new
Deeds of Restriction requires a positive majority of 51% of the
owners in each phase/subdivision, it is very important that each
owner vote. A special meeting will be held at the Forest Country
Club on February 15th
2011 at 7 PM to vote on these Proposed Amended and
Restated Deeds of Restrictions.
Upon
anticipated ratification of these amended Deeds of Restriction, the
FPOA will begin installation of the new yard lights in each Phase.
SAFETY: Wes
Alloway, our Property Manager here at the Forest , again urged all
owners to lock their vehicles left exposed overnight. as there
continue to be break-ins of cars and trucks parked outside. He also
mentioned that signs will be posted reminding all owners of this
ongoing issue.
ROADS:
Committee Chairman Victor Erml asked any condo associations who wish
to have additional light poles installed to contact him at their
convenience.
RUTHIE?S
PARK: It was mentioned that a contract to paint the gazebo within
the park was awarded to local painter Dave Shepard.
LONG RANGE
PLANNING: Chairman Vic Erml is currently assembling this Committee
designed to examine long term programs and projects to help maintain
and enhance the position of the Forest within the competitive
environment here in Southwest Florida. Any Forest resident
interested in working on this Committee should contact Mr. Erml.
UPCOMING: As
mentioned in previous articles, the waterfall restoration, so sorely
needed at our front entrance, has been on hold. President Dave
Fullen plans to reinstitute this effort as of the first of the year,
hoping to have a plan and design in place shortly. .

Elections for
the Board of Directors of the Forest Property Owner?s Association
will be held on March 13th, 2011.
The property owners of homes and lots elect the Directors of this
Board, three each from each of the four Phases of single residences
here in the Forest , as well as one representative from

In 2011,
Board seats to be filled by election are: Phase III ? 1 seat, Phase
IV ? 1 seat. Any owner from Phase III or Phase IV wishing to run for

QUILTING GROUP ? A NEW ACTIVITY AT THE
FOREST COUNTRY
CLUB
One of the
numerous activities developed by the growing ?GirlFriends Club? at
TFCC over the last year is the Quilting
Group.
Led by Sharon
Harrington, The Forest Quilters have been working on quilts since
the beginning of 2010, an initiative designed to support the Linus
Project.
The Linus
Project is a nationwide organization, currently headquartered in
Bloomington , Illinois .
It?s a project that began in 1995, providing ?security blankets? to
children being treated in the Denver Cancer Center .
Currently,
there are chapters supporting this effort in all 50 States. The
mission statement is simply ?Blankets are distributed to children in
hospitals, shelters, social services or anywhere that a child needs
a hug?.
The Forest
Quilters have completed work on approximately twenty (20) quilts
already this year to support this worthwhile program. In addition to
the work being done by the group, Phyllis Hart of Holland Michigan has been involved as
well.
Phyllis?
daughter Bev, a TFCC member, told her mother about the project and
she decided to become involved. Phyllis will be 90 in February but
wanted to donate her creations to this worthwhile project. To date,
she has completed two quilts to help the cause. This special lady is
an example of ? ?it?s never too old to make a difference?.
To this
point, members of the Forest Quilters have funded this effort
themselves. The group is looking for assistance from the Forest
Community to help continue this cause. They would greatly appreciate
cash donations to help cover some of the costs of fabrics and quilt
batting used to create these children?s quilts. Any donations of
fabrics would also be appreciated.

Proposed Deeds of
Restrictions, Phase II, III, & IV
The FPOA Board has begun the process of updating the four
home Subdivision?s Deeds of
Restrictions. The Deeds of
Restrictions defines the scope of each subdivision, setting
architectural control for house locations, size, design and the
rights of the owners within the subdivision. The original Deeds of Restriction were created in 1980.
They have been amended several times since then. They are currently
out of date both as to historical and obsolete references and state
laws as well as their reference giving the original the developer
?Declarant? rights for architectural control. The new document will
combine all of the amendments and bring the document up to current
practices. In order to amend the Deeds of
Restrictions, Phases ll, lll & lV subdivisions will receive
a restated document for each owner to consider and then vote to
ratify its adoption. Phase I propose Amended and Restated Deeds of
Restrictions were approved and ratified on May 18, 2010. Each of the
four subdivision?s documents are similar except for the definition
of architectural limits such as minimum size and location of homes
on a property.
Late December or Early January home owners in Phase II, III,
& IV will receive a copy of the propose Amended and Restated
Deeds of Restrictions for your home phase. The document includes the
original and current information. Any place where the wording is struck through has been
eliminated in the amended & restated version. Any place where
the wording is underlined has been added
as new wording. As you go through the document, you will notice that
there are few major changes in content other than terminology and
wording. The major change, other than eliminating the references to
the original developer, is the additional comments within Section B
?LAND USE. This section updates the Television and Outdoor Antenna
use to current State statutes. The document also clarifies the
issue of Mailboxes and required yard lighting. The FPOA Board has
passed a resolution to replace all current required home yard
lighting (Paid for from the FPOA capital budget) and to assume the
ongoing maintenance of those lights - other than supplying electric
power to the lights which is the owners responsibility. The FPOA
will begin installing new lights as soon as the Amended and restated
D of R are ratified by a positive vote of each sub division.
Also enclosed is a proxy form to be completed and returned.
Even if you wish to attend the special meeting (NOT A REQUIERMENT)
we ask that you complete the proxy and send it in or drop it off at
the front gate prior to the special meeting noted it your package.
Your three FPOA representatives have formed a committee to contact
each owner to be certain that you have received the packet, answer
any questions and you sent in a proxy. We ask that you make it easy
on them and act now. You may also call Wes Alloway at
the front gate if you have questions at 482-1109.
Since ratification of each subdivision?s new Deeds of Restrictions requires a positive
vote of a majority of 50% of each subdivision lot owners, it is
important that each owner register a vote.

News from the FPOA
As of this
writing, the weather has become more moderate and many of our
friends from the north have returned to the Forest . The Season has
begun.
BOARD MEETING
? to summarize
On October
19th, the FPOA Board of Directors
held its first meeting of the fall season, the first since May.
Prior to the official beginning of the meeting, questions and
comments were taken from non Board members from the Community in
attendance.
Mrs. Betty
Gillespie of Partridge Place
asked if the Board was considering the replacement of
the chain link fence that runs along Island Park Road . Due to
County permitting restrictions, the fence can not be replaced in its
entirety, at one time. Wes Alloway, Forest Property Manger,
suggested that the fence could be repaired/replaced in sections to
avoid the need for an application for a permit to replace the fence
? and when budgets permit
TREASURER
Paul Johns presented the August financial statement with the eight
months ending summary. Expenses for the first eight months were
consistent with budget levels. Spending for most capital projects
has been completed and on budget. The 2011 Budget Committee was
appointed by President Fullen.
RULES
Committee head Latham Gray was asked to meet with the nine FPOA
Board representatives from Phases II, III and IV to discuss and
review the Deeds of Restrictions that will be presented to residents
in each Phase after the first of the year.
As mentioned
previously, these outdated Deeds of Restrictions are being revised
to coincide with the updated Deeds passed overwhelmingly by the
residents of Phase I in the spring of this year. Once these
regulations are updated, the FPOA Board will continue with the
implementation of the lawn Lamp Post program introduced in Phase I
and at selected Condo entrances within the Community this
summer.
SAFETY
Committee head, Wes Alloway, reported that our surveillance system
will now include an audio record of all conversations made at the
guard house by the attendants and people passing into the Community.
This is a positive piece of technology being implemented into our
safety system. Several instances of abusive behavior by guests have
occurred over time. This system will document these situations and
allow for proper steps to be taken to rectify.
ROADS
Committee Chairman Victor Erml, reported that his team of Forest
residents, who have worked so tirelessly over the last many months
on the mail box and post lamp projects, is evaluating the
standardization the various kinds of signs currently in place within
the Forest .
Recommendations have been made and will await budget approval from
the Budget Committee, if feasible in 2011
RUTHIE?S PARK
? Gary Hamilton mentioned that new mulch has been placed in the Park
and that the entire area has been freshened.
UPCOMING ? As
mentioned in a previous article, the FPOA and the Country Club have
entered into a joint agreement dealing with Water Management and the
maintenance of the necessary canals and drainage pipes here within
the Community. Once the logistics of this agreement are finalized
with TFCC, the FPOA Board will then vote on approval or rejection of
this common interest venture
As many short
term capital projects are being completed, President Fullen
suggested that the FPOA resurrect the Long Range Planning Committee
to examine other moves that we might make to keep the Forest a current and
relevant Community. Several Board members volunteered to be a part
of this group.
Due to the
Holidays, the next Board meeting will be held on January 18th.
OTHER
ITEMS
The Community
Christmas Lights were activated on Thanksgiving. The Board has
elected not to conduct a Holiday Light Contest again this year.
Car break-ins
Apparently
there were three more auto invasions over the last month within the
Forest . Each
vehicle entered was unlocked. As we know, these kinds of offenses
are crimes of opportunity. Our own carelessness usually provides an
opportunity for a thief or vandal to strike. Even though we are a
gated Community, we can still be vulnerable and unlocked vehicle
provide an easy target.
Please take a
second to lock your vehicle and place ?items of interest? in the
house, the trunk of the car or back of the SUV. And be sure not to
leave your garage door opener in your vehicle if it?s left outside.
Whatever the item ? lock it up, take it with you or at best, hide
it, to avoid problems. And should you EVER see suspicious activity
of any kind, call the Lee County Sheriff at 477-1000. Don?t give
thieves or vandals an opportunity to strike.

News From the
FPOA
Well, we?ve
moved past the ?dog days of summer? and into September. The area
around the Forest continues to receive above average
rainfall but, to date, not tropical storm activity. By print time,
some of our northern neighbors will begin to return for the fall and
winter seasons. We hope that everyone had a great summer season
As mentioned,
we?ve had a good bit of rain; to date over 45 inches, only 9 inches
less that our average yearly total. Gary Hamilton, head of FPOA
Water Management, reports that the three major canals that flow
through our Community have performed extremely well, moving these
heavy levels of water through the Forest and into the Back Bay . Our ponds and
lakes are full ? and very attractive right now.
Last week,
the trees and vegetation were trimmed and shaped on our common
grounds and at all intersections. Overall, these areas in our
Community continue to look to be in fine shape.
As mentioned
in our article last month, 125 new post lamps were installed in the
lawns of homes in Phase 1, common areas along Club Drive and the
entrances of Dove Hollow, Dove?s Nest and Sparrowood condominium
communities.
Currently
lamps at 23 single family residences are not in operation. Several
seem to have minor problems that will be solved by our electrician
by trouble shooting the issues. Several homes however, do not have
electricity running to the old or new lamp, and thus can not be
activated. These owners have been contacted by mail and have been
asked to remedy the situation at their home. Hopefully these outages
will be rectified shortly so that we can have 100% of the lamps in
operation very soon.
The old
wooden post lamps were to have been removed shortly after the
installation of the new lamps. At this writing, they have not been
removed, by it?s been reported that they will be taken out by mid
September.

RULES AND REGULATIONS (a few reminders)

#11 ? Vehicles shall
not be parked on the paved right of way, sidewalks or lawns,
including
vehicles of contractors and workmen. Lawn maintenance and other
service vehicles may park on the street in
front of the property at which they are working.
Contractor hours for service in The Forest are Monday through
Saturday 7:00AM to 6:00PM. No work is authorized on Sundays or the
following observed Holidays: New Years Day, Memorial Day,
Independence Day, Labor Day, Thanksgiving Day and Christmas Day. It
should also be noted that, except in an emergency, the gate
attendant will not allow contractor entry on Sundays or Holidays. In
the case of any emergency however, please call the gate attendant
for prompt entry.

FPOA OCTOBER
MEETING
- Our
first fall meeting of the FPOA Board of Directors will be held on
October 19th,
2010 in the
Forest Country
Club Clubhouse. In addition to other sections of the
agenda, the
2011 Budget Committee will be appointed at the meeting. Paul Johns,
our
FPOA Treasurer,
will review the status of our 2010 budget as well. Your attendance
is
welcome. As
usual, attendees will be given an opportunity to ask questions
and/or
make comments
prior to the start of the formal meeting. Please make every effort
to
attend and
learn more about what?s going on in your Forest Community.
Not to
belabor a point but --- once again several Forest residents have
complained this month about the inordinate amount of pet
?leave behind? scattered around the Community. As mentioned last
month, it?s every pet owner?s responsibility to clean up after their
dog when walking him/her around the neighborhood. Again, PLEASE take
the time and ?do the right thing? by cleaning up after your pet and
disposing the waste in an appropriate receptacle. And again,
remember that the Golf Courses are not dog walks. Please keep your
pets off the Golf Courses and on the common areas of the Forest .
Work on the
renovation of the Bear Golf course is practically completed. All
activity, aside from grow-in and maintenance should be completed by
the end of September.
Project
Supervisors and TFCC Board Members, Clyde Severson and Rich Stoufer
promise to submit a progress report and projections up for our
November edition of the Forest Matters.

News From the
FPOA
Summer is
here in full force. Hot, humid with rain. In fact we?ve officially
accumulated nearly 51/2 inches in July alone as of the 6th, with nearly 30 inches year to date.
No drought this year. Lawns are green, trees are full and the
neighborhood is relatively quiet.
Since last
November, the Country Club, through the auspices of the Membership
Relations Committee, has sponsored Water Aerobics Classes here in
the Community. Lorraine Guile, one of the coordinators of this
program, relates that these Classes have been a real success with at
times over 20 participating per session. Stacie Bailey, a certified
instructor, leads the hour long program of cardio fitness and
strength exercises.Lorraine mentioned that these
activities provide muscular endurance, improved flexibility and
cardiovascular conditioning, and perhaps best of all, burn
calories
Due to summer
inactivity, the classes are suspended for August but will resume in
mid September. During ?season? these hour long classes will
alternate between three different pools within the Community and are
currently scheduled for Monday and Wednesday mornings beginning at
9:30 AM. The cost is but $5.00 per session. All members of the
Forest Community are welcome. For more information please call
Lorraine Guile, Bobbee Gabelmann or Anita Ryan.
In addition,
a program of fitness classes is being offered by Fitness 24/7 in the
Forest Plaza ,
behind the Goodwill Outlet. Bryan Raymond, studio owner, is offering
seven different sessions designed to improve cardio, body toning and
flexibility. Classes will continue throughout the summer. In
addition, classes in Yogalates, Cardio Sculpt as well as traditional
Yoga are available providing a wide variety of ways of ?getting
fit?. Classes are scheduled on Monday, Wednesday, Thursday and
Saturdays. Many class payment options are available and are offered
to all Forest Community residents.
Wes Alloway,
our Property Manager here in The Forest, reports that two unlocked

stolen from these vehicles during the break-ins. Vehicle burglaries
are most often crimes of opportunity. Our own carelessness usually
provides the opening for thieves or vandals to strike.
Even though
we are a gated community, we are still vulnerable. An unlocked
vehicle provides an easy target. Please take an extra second to
secure your vehicle. Place ?items of interest? in the house, in the
trunk or secluded in the back of your car or SUV. Also, be sure not

ready entry into your home if in the hands of the wrong person. As
Wes has always suggested, take it with you, hide it or lock it up if
you don?t want to lose it!! And should you EVER see suspicious

Since the
first of May, the most visible activity here within the Forest is the renovation
of the Bear Course at the Country Club. Sanders Golf of Tennessee, a
very reputable firm that among other assignments, is responsible for
all work concerning the greens at Augusta National - home of the
Masters Tournament - is the contractor in charge of the project.
Work being done includes the installation of a sorely needed new
irrigation system for the course, brand new greens plus a revamped
driving range and practice area.
Rich Stoufer
and Clyde Severson are the TFCC Committee heads of this project.
Both Rich and Clyde have spent a great deal of time this
spring and summer overseeing this effort. Although there was little
rain to hinder work during the first six weeks of the project,
Sanders encountered more embedded rock under the fairways and greens
than anticipated. These conditions had impacted scheduling. However,
with the help of Course Superintendent Matt Cann and Club General
Manager Chris Bruhnke, Rich relates that the project is indeed on
schedule for a November 1st
completion ? unless untold inclement weather occurs, always a
possibility here in Southwest Florida ..

News from the
FPOA ?
Our May FPOA
Board Meeting was held on the 18th.
The key announcement made by President Dave Fullen was the passage
of the Revised Deeds of Restriction for Phase One. Sixty eight of
the one hundred eligible residences, including Partridge Court , responded to
this referendum. Sixty One affirmative votes passed the measure. As
outlined in several correspondences from the FPOA Board, the
approval of our revised Deeds of Restrictions allows Phase One to
continue on as a structured, dedicated portion of the Forest Community. The
renewal of the Deeds of Restriction for the remaining three Phases
within our Community will be addressed this fall. Their content
should be much the same as the new Deeds drawn up and provided by
our designated law firm, Becker & Poliakoff.
As most of us
know, the FPOA was created originally as a vehicle to monitor water
management within the Forest Community. As the years have passed the
FPOA has assumed responsibility for our roads, lighting, safety and
more. During the May board meeting, President Fullen also announced
the creation of a new agreement between the FPOA and the Forest
Country Club to monitor and execute the water management function
within our Community. With the deterioration of much of our casing
and culvert system after 30 years of existence, it?s important that
we address this issue before we experience significant problems as
time progresses. This agreement defines the commitment and
responsibility for the water management function for both FPOA and
TFCC, a real step forward in the working together approach being
maintained by management from both organizations. This agreement is
being reviewed by each FPOA board member, with discussion and
resolution to take place at our first fall meeting in October.
As suggested
in the May edition of Forest Matters, new paving was completed along
Timberlakes
Drive from the front gate to Bear Cub Court . All striping
has been finished as well, significantly upgrading this section of
our road system.
With the
passing of the Phase One Deeds of Restrictions, the new coach lights
described in the May edition of the Forest Matters, will be installed at single
homes and the entrance way to selected condo/town home complexes
within the Community. Again, these lights are being installed for
several reasons: 1) better illumination along our streets 2) as an
upgrade to the overall appearance of our Community, as the Forest
continues to mature as a neighborhood and to remain competitive with
other areas in south Ft. Myers and unincorporated Lee County . 3) as a complement to
the new mailboxes installed earlier this year. The FPOA plans to
install these same new lights at remaining homes and condo/town
homes complexes in 2011.
On the first
Tuesday of each month, Gary Hamilton the head of the Forest Grounds
Committee and the supervisor from CLA Company, our community
landscaping service, are visited by a representative from OLM of
Tampa. OLM is an organization that is responsible for rating and
grading the performance of our landscaping company, as well as those
of other communities in our area. The overall appearance of our
property is evaluated. In addition the heights of plantings along
our streets are checked for the safety of auto, pedestrian and
bicycle traffic. Current conditions are appraised as is the follow
up expected from previous months? evaluations. Gary mentioned that these quality
control checks help make sure that the appearance of our common
grounds is maintained to the high standards that most of us expect.

Recently,
there have been several complaints concerning unleashed dogs running
loose in the Community, particularly in the Ruthie?s Park area. Lee
County
Animal
Control Ordinance No. 09-20 clearly outlines the expected behavior
and restrictions required for the direct control of all dogs within
the Forest .
Many of us have pets ? dogs, cats, etc. However, it is everyone?s
responsibility to control their animals, in all facets of their
behavior, particularly when they are off of their own property.

Apparently
there have been comments made recently concerning the health and
stability of the Country Club. A person(s) living outside of our
Community was told by one of our residents that TFCC was in an
unfavorable financial position, and would be looking to the FPOA/
Community for financial support. There is absolutely no truth to
this. TFCC continues to be a solid fiscal operation being run by
sound management and management practices. FPOA and TFCC will
continue to work together in the best interest of the Forest Community
regarding areas of interest to both entities.

The proposed/revised Deeds of Restrictions have been mailed to ALL homeowners in the three Phases ? II, III and IV. They should be reviewed carefully. Please return the PROXY in the postage paid envelope provided. Since ratification of each subdivision?s new Deeds of Restriction requires a positive majority of 51% of the owners in each phase/subdivision, it is very important that each owner vote. A special meeting will be held at the Forest Country Club on February 15th 2011 at 7 PM to vote on these Proposed Amended and Restated Deeds of Restrictions.
Proposed Deeds of
Restrictions, Phase II, III, & IV
The FPOA Board has begun the process of updating the four
home Subdivision?s Deeds of
Restrictions. The Deeds of
Restrictions defines the scope of each subdivision, setting
architectural control for house locations, size, design and the
rights of the owners within the subdivision. The original Deeds of Restriction were created in 1980.
They have been amended several times since then. They are currently
out of date both as to historical and obsolete references and state
laws as well as their reference giving the original the developer
?Declarant? rights for architectural control. The new document will
combine all of the amendments and bring the document up to current
practices. In order to amend the Deeds of
Restrictions, Phases ll, lll & lV subdivisions will receive
a restated document for each owner to consider and then vote to
ratify its adoption. Phase I propose Amended and Restated Deeds of
Restrictions were approved and ratified on May 18, 2010. Each of the
four subdivision?s documents are similar except for the definition
of architectural limits such as minimum size and location of homes
on a property.
Late December or Early January home owners in Phase II, III,
& IV will receive a copy of the propose Amended and Restated
Deeds of Restrictions for your home phase. The document includes the
original and current information. Any place where the wording is struck through has been
eliminated in the amended & restated version. Any place where
the wording is underlined has been added
as new wording. As you go through the document, you will notice that
there are few major changes in content other than terminology and
wording. The major change, other than eliminating the references to
the original developer, is the additional comments within Section B
?LAND USE. This section updates the Television and Outdoor Antenna
use to current State statutes. The document also clarifies the
issue of Mailboxes and required yard lighting. The FPOA Board has
passed a resolution to replace all current required home yard
lighting (Paid for from the FPOA capital budget) and to assume the
ongoing maintenance of those lights - other than supplying electric
power to the lights which is the owners responsibility. The FPOA
will begin installing new lights as soon as the Amended and restated
D of R are ratified by a positive vote of each sub division.
Also enclosed is a proxy form to be completed and returned.
Even if you wish to attend the special meeting (NOT A REQUIERMENT)
we ask that you complete the proxy and send it in or drop it off at
the front gate prior to the special meeting noted it your package.
Your three FPOA representatives have formed a committee to contact
each owner to be certain that you have received the packet, answer
any questions and you sent in a proxy. We ask that you make it easy
on them and act now. You may also call Wes Alloway at
the front gate if you have questions at 482-1109.
Since ratification of each subdivision?s new Deeds of Restrictions requires a positive
vote of a majority of 50% of each subdivision lot owners, it is
important that each owner register a vote.

News from the FPOA
As of this
writing, the weather has become more moderate and many of our
friends from the north have returned to the
BOARD MEETING ? to summarize
On October 19th, the FPOA Board of Directors held its first meeting of the fall season, the first since May. Prior to the official beginning of the meeting, questions and comments were taken from non Board members from the Community in attendance.

TREASURER Paul Johns presented the August financial statement with the eight months ending summary. Expenses for the first eight months were consistent with budget levels. Spending for most capital projects has been completed and on budget. The 2011 Budget Committee was appointed by President Fullen.
RULES Committee head Latham Gray was asked to meet with the nine FPOA Board representatives from Phases II, III and IV to discuss and review the Deeds of Restrictions that will be presented to residents in each Phase after the first of the year.
As mentioned previously, these outdated Deeds of Restrictions are being revised to coincide with the updated Deeds passed overwhelmingly by the residents of Phase I in the spring of this year. Once these regulations are updated, the FPOA Board will continue with the implementation of the lawn Lamp Post program introduced in Phase I and at selected Condo entrances within the Community this summer.
SAFETY Committee head, Wes Alloway, reported that our surveillance system will now include an audio record of all conversations made at the guard house by the attendants and people passing into the Community. This is a positive piece of technology being implemented into our safety system. Several instances of abusive behavior by guests have occurred over time. This system will document these situations and allow for proper steps to be taken to rectify.
ROADS
Committee Chairman Victor Erml, reported that his team of Forest
residents, who have worked so tirelessly over the last many months
on the mail box and post lamp projects, is evaluating the
standardization the various kinds of signs currently in place within
the
RUTHIE?S PARK ? Gary Hamilton mentioned that new mulch has been placed in the Park and that the entire area has been freshened.
UPCOMING ? As mentioned in a previous article, the FPOA and the Country Club have entered into a joint agreement dealing with Water Management and the maintenance of the necessary canals and drainage pipes here within the Community. Once the logistics of this agreement are finalized with TFCC, the FPOA Board will then vote on approval or rejection of this common interest venture

Going Away For Weekend Or Longer?
PLEASE inform your neighbors when you leave and for how long. If possible, leave an extra key with someone and please set your alarm (if you have one).
Also PLEASE provide the number of days you'll be away, as well as your cell phone number and a point of contact where you can be reached - along with the name/contact information for the local person who will have your key - to our staff at the gate house by using the form shown below. Just drop the form off at the front gate house, fax to us (239-482-3366) or e-mail it to fpoa@forestpropertyowners.com.
If you wish, while you are gone, our safety night driver will randomly check your home, walking around the property checking for open doors, windows, torn screens, etc. If he discovers anything out of line, it will be reported to you and the person holding your key. If forced entry is suspected by our person, the instance will be reported immediately to the Lee County Sheriff's Department.
Also, CONDO Owners, please follow the same procedure. Please alert our staff when you will be away. The expected dates and all other pertinent information will be entered into our computer system for ready reference.
